NYSC: 10 During-Service Offences and Sanctions

The second stage after the NYSC 21-day orientation is service. Your engagement for the rest of 1-year national service has laws that guide it.

And for any offence, the NYSC bye-law has you a commensurate sanction. Some of these punishments can be more severe to extent of rerunning the national call.

In this post, I will be covering a series of well-known offences you may fall for while serving at NYSC to deserve the wrath of the law.

Rules Guiding Your Service Period and the Punishment(s) for Each Offence

After leaving camp (see NYSC During-Orientation Offences and Punishments) comes the real service. Below is the list of offences covered by the NYSC by-law and sanctions due.

1. Refusal or Rejection of Posting

After the 21-day camping period, each corper will be posted to his or her place of primary assignment. It's a grave offence to reject this posting for any reason whatsoever.

Any member who refuses to accept posting to primary assignment shall forfeit the allowance for the number of months out of work and also serve an extension of double the number of months out of work with half pay.

2. Reporting Late to the Place of Assignment

After being dispatched at the orientation camp, each corp member must report to his or her place of the assignment immediately (the same day if possible).

Any member who reports late at duty station shall be tried by the Corps Disciplinary Committee and if found guilty, be liable to extension of service on half pay double the period he is late to station.

3. Failure to Be Punctual at Work

Punctuality in this sense means being regular and timely to work after reporting to the place of primary assignment.

Any member who reports late for duty shall be queried by his employer and the report sent to the State Coordinator for disciplinary action
Any member who fails to carry out his duties diligently shall be queried by his employer and the report sent to the State Coordinator for disciplinary action
Any member who leaves his duty station or absents himself from any official activity without the permission of the State Coordinator shall be tried by the Corps Disciplinary Committee and, if found guilty, be liable to extension of service with half pay double the period of absence.
Any member who travels outside the State without the written permission of the State Coordinator shall be tried by the Corps Disciplinary Committee and, if found guilty, be liable to forfeiture of allowance for the number of days absent and extension of service with half pay double the period of absence

4. Being Rude to Your Employer

Being rude to your employer is a grave offence while serving. This extends to being immoral at work, disclosure of official information of the employer, leaking of exam questions (for those teaching) and engagement in private dealings to the detriment of the employer. Hence, NYSC gives employers the freedom to report and consequently sanction you.

Any member who is rude to the constituted authority shall be tried by the Corps Disciplinary Committee and, if found guilty, be liable to extension of service for a period not less than thirty (30) days with half pay
Any member who engages in immoral practices shall be tried by the Corps Disciplinary Committee and, if found guilty, be liable to extension of service for thirty (30) days without pay
Any member who discloses official information shall be tried by the Corps Disciplinary Committee and, if found guilty, be liable to extension of service for a period not less than thirty (30) days without pay.
Any member who leaks examination question shall be reported to police for prosecution
Any member who engages in private practice shall be tried by the Corps Disciplinary Committee and, if found guilty, be liable on conviction to the extension of service for a period not less than twenty-one (21) days without pay.

5. Taking Legal Actions Against Employer or Other Corps

Just as you can be tried while serving, you're also allowed to try others. However, there are limits and a few things to take into consideration especially if the matter involves your employer and/or co-corper. You must first inform the Director-General of an amicable settlement of the matter.

If any member refuses, fails, or neglects to comply with this rule, his Certificate of National Service shall be withheld till the determination of the case in Court.

6. Travelling Outside the Country

Of course, you're not expected to travel outside Nigeria while serving. However, it's not far from reality to see corpers who have the need to go abroad.

In case, you can only go with the written permission of the Director-General.

Otherwise, you may be tried by the Corps Disciplinary Committee and, if found guilty, be liable to extension of service without pay, for double the period of absence

7. Soliciting Funds/Help or Engaging in Partisan Politics

No corper is allowed to solicit financial help from an individual or organization during the service year.

Under no circumstances, should you seek funds from individuals, State and Local Governments, companies and multinationals, to execute a project or similar purpose without the consent of the State Coordinator. Otherwise,

such a coper shall be tried by the Corps Disciplinary Committee and, if found guilty, shall be liable to the following penalties: (i) Non-recognition of the project for any award; and (ii.) Extension of service for twenty-one (21) days without pay.
Any member who takes part in partisan politics is liable to extension of service for a period not less than three (3) months without pay.

8. Losing NYSC Identity Card

You're to guard your NYSC ID card while serving. If lost, it may lead to a fine and an extension of the service period.

Any member who loses the NYSC identity card is liable to a fine of five hundred naira (N500.00) which shall be receipted.

Any member who fails, refuses, or neglects to produce his identity card on demand by an NYSC official is liable to extension of service for a period not less than twenty-one (21) days with half pay.

9. Forming a Group or Organization

Of course, NYSC already has several NYSC-based organizations for sanitation and education of the people within your community. You can belong to any of that organizations without issue. Other religious organizations such as the Muslim Corpers' Association Of Nigeria (MCAN), Nigeria Christian Corpers' Fellowship (NCCF) etc can be joined by any corper.

However, you're not allowed to start a new organization, club, group or function without the consent of the State Coordinator.

Otherwise shall be liable to the following penalties: (i.) Proscription of the group; and (ii.) Extension of service for a period not less than fourteen (14) days with half pay.

10. Involving in Fraud and/or Kidnapping

One of the anomalies in the nation today is fraud so also is kidding or related crimes.

Any member who is involved in fraud or kidnapping shall be reported to the police for prosecution.
